Is Ripple Negotiating for a Better Deal?<\/h2>\n

The<\/span> US Securities and Exchange Commission (SEC) has changed its hostile tone toward the digital asset industry <\/span>under its new leadership<\/span>.<\/span> Over the past several weeks, it dismissed some of its lawsuits against crypto entities, including those against <\/span>Coinbase<\/span><\/a>, Uniswap, and others. However, the case against Ripple remains ongoing more than four years after its start.\u00a0<\/span><\/p>\n

One<\/span> expert sharing his theory of why the legal battle has <\/span>still not officially ended is James Murphy<\/span>.<\/span> The attorney, who uses the X moniker MetaLawMan, <\/span>thinks<\/span><\/a> the company might be \u201ctrying hard to get the SEC to agree to vacate some or all of Judge Torres\u2019 decisions.\u201d\u00a0<\/span><\/p>\n

One of the magistrates\u2019 rulings (from last summer) <\/span>states<\/span><\/a> that Ripple violated <\/span>certain<\/span> rules and should pay a fine of $125 million. The XRP army and the firm <\/span>itself<\/span> interpreted the order as a clear victory since the SEC previously insisted on a $2 billion penalty.\u00a0<\/span><\/p>\n

Murphy also sees the decision as \u201cgreat\u201d for XRP holders but suggested that the findings that Ripple has breached some laws \u201cis not so great\u201d for the company\u2019s reputation.\u00a0<\/span><\/p>\n

\u201cThis is particularly true if Ripple is considering a future exempt securities offering or IPO. I believe the SEC would have accepted a settlement \u2013 where both sides dismiss their appeals and the SEC takes the $125 million penalty \u2013 in a heartbeat,\u201d the expert added.<\/span><\/p>\n

\u2018Ripple and the SEC Live Together and Have a Baby\u2019<\/span><\/h2>\n

Another person who recently <\/span>chipped in on<\/span> the matter was <\/span>the<\/span> American attorney Jeremy Hogan.<\/span> He <\/span>opined<\/span><\/a> that the case between Ripple and the securities regulator is more complicated than the rest and would <\/span>most<\/span> likely <\/span>be resolved<\/span> after a settlement rather than dismissed.<\/span>\u00a0<\/span><\/p>\n

\u201cThe SEC broke up with Coinbase after a\u00a0<\/span>couple<\/span> dates. Ripple and the SEC live together and have a baby,\u201d he stated.\u00a0<\/span><\/p>\n

Eleanor Terrett (a journalist at Fox Business) agreed with the thesis. She <\/span>claimed<\/span><\/a> that the Ripple lawsuit is \u201cmore procedurally complex\u201d than the one against Coinbase because Judge Torres has already ordered a $125 million penalty on the company. The journalist reminded that the magistrate can retain jurisdiction until August 7 \u201cto make sure the\u00a0<\/span>terms of the order<\/span>\u00a0<\/span>are met<\/span>.\u201d<\/span><\/p>\n
