Prediction markets<\/a> are becoming a bigger issue on Capitol Hill, and lawmakers are now arguing about how the industry itself should be examined.<\/p>\n All 11 Democratic members of the Senate Banking Committee have asked Chairman Tim Scott to hold a public hearing on prediction markets, following a private Republican meeting with Kalshi CEO Tarek Mansour.<\/p>\n The Commodity Futures Trading Commission<\/a> has traditionally been the federal regulator most closely associated with event contracts.<\/p>\n But prediction markets are pushing into territory that does not fit neatly inside one box.<\/p>\n Products tied to corporate earnings, securities or other company-specific outcomes could raise questions involving the Securities and Exchange Commission<\/a> as well.<\/p>\n That brings the Senate Banking Committee into the discussion.<\/p>\n In their September 23 letter, committee Democrats argued that the full panel has an oversight role and called for the industry to be examined publicly and on a bipartisan basis.<\/p>\n Scott separately said the Republican meeting with Kalshi covered innovation, retail-investor protection and regulatory questions surrounding securities-linked products.<\/p>\n This is not simply another argument about sports betting.<\/p>\n Prediction platforms are expanding into economic releases, corporate events, politics and financial-market outcomes.<\/p>\n At the same time, states continue to challenge some sports event contracts while federal regulators<\/a> argue over where jurisdiction starts and stops.<\/p>\n That creates an awkward structure.<\/p>\n A contract can look like a derivative, a prediction market, a gambling product or something resembling a securities-linked option depending on what event determines the payout.<\/p>\n The request for a public Banking Committee hearing does not create a new law or change Kalshi\u2019s regulatory status.<\/p>\n It does show that prediction markets are becoming difficult for Congress to treat as a niche CFTC issue.<\/p>\n As the products move closer to traditional financial markets, more committees and agencies are likely to want a say.<\/p>\n For the industry, that could mean more legitimacy \u2014 but also a lot more scrutiny.<\/p>\nPrediction Markets Are Crossing Regulatory Boundaries<\/h2>\n
