CFTC Sends Proposal To Regulate Crypto Transactions Following Clarity Act Fail<\/a><\/p>\n

The Commodity Futures Trading Commission on Thursday sent a proposal to the White House to regulate crypto transactions and markets.\u00a0<\/p>\n

It isn\u2019t clear what the regulations will look like from the post on the Office of Management and Budget\u2019s website. The proposal is titled<\/a> \u201cRegulation Crypto Asset Transactions and Regulation Crypto Asset Markets.\u201d<\/p>\n

The CFTC\u2019s move comes after lawmakers blocked<\/a> the long-awaited crypto legislation Clarity Act<\/a> on Tuesday. Despite the law not advancing, both the CFTC and Securities and Exchange Commission have said they would go ahead with crypto rulemaking anyway.\u00a0<\/p>\n

CFTC Chair Mike Selig said on Wednesday that while the Clarity Act didn\u2019t move forward, the watchdog would still help U.S. President Trump \u201cget the job done\u201d in regulating the crypto space.\u00a0<\/p>\n

\u201cThe outcome of yesterday\u2019s Senate vote was unfortunate,\u201d Selig wrote<\/a> on X, adding that the CFTC was \u201clocked in and ready to ship its rules for the new frontier of finance.\u201d<\/p>\n

Before the procedural vote on the legislation this week, Selig had said would proceed with rulemaking whether or not the Clarity Act is enacted \u2014 with the aim of finalizing rules before the administration\u2019s term is out.<\/p>\n

Senators last year approved Selig as the regulator\u2019s chair. Formerly chief counsel at the SEC\u2019s Crypto Task Force, Selig was described<\/a> by White House\u2019s Crypto and AI Tsar, David Sacks, as \u201cinstrumental in driving forward the President\u2019s crypto agenda\u201d\u00a0<\/p>\n

President Trump campaigned on a ticket to help the crypto space after regulators under the previous administration hit digital asset businesses with lawsuits \u2014 mostly for allegedly selling unregistered securities.\u00a0<\/p>\n

Since Trump became president, the SEC and CFTC have taken a much friendlier approach to watchdogging the space.\u00a0<\/p>\n

The CFTC isn\u2019t the only regulator going ahead with rulemaking: the SEC earlier this week approved<\/a> tokenized stocks trading. In August, it also proposed<\/a> its own framework for crypto asset offerings, pressing ahead while the landmark legislation stalled.\u00a0<\/p>\n

President Trump last month urged lawmakers to pass the Clarity Act, calling the legislation \u201cvery powerful\u201d \u2014 but Republicans said that Democrats were deliberately holding it back.\u00a0\u00a0<\/p>\n

Democrats mainly took issue with the ethics side of the bill. Trump received backing from major industry players while campaigning and since becoming president, his family has made money from digital asset ventures.\u00a0<\/p>\n

Some lawmakers have alleged conflicts of interest. The White House has always denied any wrongdoing.\u00a0<\/p>\n

A new draft of the bill started circulating in July tackling the issue of ethics and banning officials from making money from crypto. But some Democrats said it didn\u2019t go far enough.\u00a0<\/p>\n

The Clarity Act wants to formally divide oversight between regulators, distinguishing which digital assets are securities, commodities or stablecoins.\u00a0<\/p>\n
