The U.S. Securities and Exchange Commission (SEC) has distributed $4.6 million to investors harmed by BitClave\u2019s unregistered initial coin offering (ICO). <\/span><\/p>\n

The announcement, made on November 20, follows a settlement BitClave reached with the SEC in 2020.<\/span><\/p>\n

BitClave, an Ethereum-based search engine, conducted a $25.5 million ICO in 2017, offering Consumer Activity Tokens (CAT). The SEC later classified the offering as a securities sale, citing that investors <\/span>were led to believe<\/span> CAT would appreciate <\/span>in value<\/span>. <\/span><\/p>\n

BitClave Agrees to Return Funds Raised<\/span><\/h2>\n

BitClave did not admit wrongdoing but agreed to return the funds raised and pay an additional $4 million in penalties.<\/span><\/p>\n

\u201cThe checks are in the mail,\u201d the SEC said in a statement on X (formerly Twitter). \u201cWe are sending out more than $4.6M to investors harmed by BitClave PTE Ltd.\u2019s unregistered ICO of digital asset securities.\u201d<\/span><\/p>\n

The funds were distributed from the Fair Fund, an escrow account created to compensate approximately 9,500 investors. As part of the settlement, BitClave also agreed to burn 1 billion uncirculated CAT tokens and request the delisting of its token from exchanges.<\/span><\/p>\n

The case highlights the SEC\u2019s aggressive regulatory approach under President Joe Biden\u2019s administration, which has initiated over 100 actions against crypto firms.<\/span><\/p>\n

The SEC has taken a\u00a0tougher\u00a0stance against crypto firms in 2024. More specifically, the regulator\u00a0<\/span>imposed nearly $4.7 billion<\/span><\/a>\u00a0in enforcement actions against crypto companies, a 3,018% increase from 2023.<\/span><\/p>\n

The fines included forfeitures, disgorgement, civil penalties, settlements, and prejudgment interest, calculated from\u00a0<\/span>the time<\/span> the SEC initiated each case.<\/span><\/p>\n

The agency also <\/span>faced\u00a0<\/span>a barrage of<\/span>\u00a0criticism<\/span><\/a> during a\u00a0congressional hearing\u00a0on Wednesday, 18 September 2024.\u00a0This\u00a0came as a predominantly critical witness panel voiced\u00a0their\u00a0concerns over the\u00a0agency\u2019s\u00a0regulatory approach\u00a0towards\u00a0digital assets.<\/span><\/p>\n

It is worth noting that the regulatory agency has also faced some setbacks. Back in July, the SEC\u00a0<\/span>closed its three-year investigation<\/span><\/a>\u00a0into Hiro Systems. The\u00a0agency\u2019s\u00a0conclusion came just a day after it closed a separate case involving\u00a0<\/span>stablecoin<\/a> issuer Paxos.<\/span><\/p>\n

Trump Pledges to Overhaul SEC Leadership<\/span><\/h2>\n

In a related development, President-elect Donald Trump has pledged to overhaul the SEC\u2019s leadership. <\/span><\/p>\n

Trump has criticized the agency\u2019s regulatory stance and promised to replace the current Chair, Gary Gensler. He has also expressed ambitions to make the U.S. the global leader in cryptocurrency innovation.<\/span><\/p>\n

The SEC has seen notable leadership changes this year, with Gurbir Grewal stepping down as head of enforcement on October 2. Reports suggest that Trump may create a new White House position dedicated to cryptocurrency policy, a historic first.<\/span><\/p>\n
