Cynthia Lummis (R-Wyo.), bars federal public officials and their spouses from issuing or sponsoring a new digital asset while in office.<\/p>\n<p>Platforms are prohibited from listing any asset issued in violation of that rule. Officials with pre-existing crypto holdings can remain compliant by placing those assets in a qualified blind trust or divesting them.<\/p>\n<p>Enforcement authority rests exclusively with the Department of Justice. State attorneys general are explicitly barred from bringing any enforcement actions.<\/p>\n<p>The provision sunsets at noon on January 20, 2029,\u00a0the final day of Trump\u2019s second term \u2013 and prohibits the DOJ from prosecuting violations after that date, even for conduct that occurred while the provision was in force.<\/p>\n<p>Trump\u2019s financial disclosures, released in late June, show more than $1Bn in crypto-related income in 2025, tied to ventures including World Liberty Financial and the TRUMP meme coin.<\/p>\n<p><a class=\"general-link\" href=\"https:\/\/99bitcoins.com\/visit\/kalshi\" target=\"_blank\" rel=\"noopener\"><\/a><\/p>\n<h2>The Seven Democrats and Their Objections<\/h2>\n<p>On July 22, Angela Alsobrooks (D-Md.) and several other Democratic senators criticized the CLARITY Act for falling short in areas like ethics, consumer protection, and market integrity.<\/p>\n<p>At a Semafor event, Alsobrooks specifically objected to the proposed DOJ-only enforcement, calling it \u201cwild and unserious,\u201d while Democrats are advocating for state attorneys general to have enforcement authority, a demand Republicans oppose.<\/p>\n<p>The Democratic concerns include that the provision only affects new crypto issuances, allowing Trump\u2019s existing income streams to remain untouched; the enforcement mechanism grants oversight to a presidentially appointed attorney general.<\/p>\n<p>The provision\u2019s January 20, 2029, sunset effectively grants retroactive immunity after Trump leaves office. Notably, Sen.
