John Boozman (R-Ark.) opened the markup by touting months of negotiations and \u201csubstantive, cordial conversations,\u201d but acknowledged that \u201cfundamental policy disagreements\u201d remain.<\/p>\n<p>\u201cNow it\u2019s time to move this process forward,\u201d Boozman <a href=\"https:\/\/www.agriculture.senate.gov\/hearings\/business-meeting-01-27-2026\" target=\"_blank\" rel=\"noopener\">said<\/a>, emphasizing the need to flesh out a regulatory regime for digital commodity intermediaries \u2014 including exchanges, brokers, dealers, and custodians \u2014 under the CFTC\u2019s oversight.<\/p>\n<p>This discussion emerged from the Agriculture Committee\u2019s updated legislative text <a href=\"https:\/\/www.dwt.com\/blogs\/financial-services-law-advisor\/2026\/01\/senate-ag-committee-crypto-market-structure-text\" target=\"_blank\" rel=\"noopener\">released<\/a> on January 21, which builds on a bipartisan discussion draft issued in November and on the House-passed Digital Asset Market CLARITY Act of 2025.\u00a0<\/p>\n<p>The legislation aims to finally settle long-standing questions about how digital assets should be regulated in the U.S. by giving the CFTC exclusive jurisdiction over spot markets for \u201cdigital commodities,\u201d while leaving securities-related digital assets under the Securities and Exchange Commission.<\/p>\n<div class=\"wp-block-embed__wrapper\">\n<p>JUST IN:  Senate Agriculture Committee PASSES Bitcoin and crypto market structure legislation out of committee. <a href=\"https:\/\/t.co\/6KB2uzbfQe\">pic.twitter.com\/6KB2uzbfQe<\/a><\/p>\n<p>\u2014 Bitcoin Magazine (@BitcoinMagazine) <a href=\"https:\/\/twitter.com\/BitcoinMagazine\/status\/2016911994717122688?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">January 29, 2026<\/a>\n<\/p><\/div>\n<h2 class=\"wp-block-heading\">Bipartisan crypto aspirations clearly undercut committee discussions\u00a0<\/h2>\n<p>While initial versions of the Agriculture Committee\u2019s language were released jointly by Boozman and Democratic Sen. Cory Booker (D-N.J.), Thursday\u2019s markup showed some fractures along party lines.\u00a0<\/p>\n<p>Booker reminded colleagues that the bipartisan November draft represented \u201cone of my better experiences in the Senate,\u201d but argued that Republicans abandoned the bipartisan process after the Christmas recess.<\/p>\n<p>\u201cTo be clear, the product before us today is not the bipartisan draft that we were working on,\u201d Booker <a href=\"https:\/\/x.com\/EleanorTerrett\/status\/2016900900653072474\">said<\/a>.<\/p>\n<p>Ranking Member Sen. Amy Klobuchar (D-Minn.) indicated that Democrats support \u201cthe progress that has been made,\u201d but stressed that key issues remain unresolved \u2014 particularly ethics safeguards for public officials and stronger consumer protections.<\/p>\n<h2 class=\"wp-block-heading\">Failed Democrat amendments\u00a0<\/h2>\n<p>Several Democrat-led amendments failed on the committee floor. An ethics-focused amendment that would have barred the President, Vice President, federal elected officials, and certain family members from profiting off crypto while in office \u2014 and required covered assets to be placed in blind trusts \u2014 was defeated.\u00a0<\/p>\n<p>Other Democratic proposals addressing crypto ATM fraud protections, bankruptcy protections for crypto intermediaries, and expanded consumer safeguards also did not pass.<\/p>\n<p>Sen. Adam Schiff (D-Calif.) echoed concerns about ethics, urging language that covers all federal officials.\u00a0<\/p>\n<p>Sen. Elissa Slotkin (D-Mich.) charged that Republican opposition would be louder if similar provisions targeted past Democratic administrations, alluding to <a href=\"https:\/\/www.bloomberg.com\/news\/features\/2026-01-20\/donald-trump-family-net-worth-increasingly-comes-from-crypto?embedded-checkout=true\" target=\"_blank\" rel=\"noopener\">reported financial gains<\/a> by the Trump family from crypto assets while in office.<\/p>\n<p>Despite all the discussions, the meeting ended in a vote roughly an hour after deliberations took place.\u00a0\u00a0<\/p>\n<p>Senator Cynthia Lummis celebrated the deliberation results, <a href=\"https:\/\/x.com\/SenLummis\/status\/2016912617848135686\">posting<\/a> on X, \u201cGreat to see digital asset market structure pass [the Senate Agriculture Committee.] We are one step closer to getting this legislation to [the President\u2019s] desk, and I look forward to continuing to work closely with my colleagues across the aisle to make America the digital asset capital of the world.\u201d<\/p>\n<h2 class=\"wp-block-heading\">What comes next?\u00a0<\/h2>\n<p>What comes next is a long and procedurally heavy road.
